2. SCOPE OF COLLECTION OF PERSONAL DATA
- When contacting via the Website, e-mail, etc., the User may be asked to provide his personal data, such as name, surname, telephone number, e-mail address, etc. Additionally, such information is saved when using the Website. about the User, such as: IP address, date and time of access, name and version of the browser, name of the operating system, URL address, subpages used by the User, data transmission volume, Cookies, as well as demographic data, age, gender, language, location , geographical data (hereinafter referred to as: Personal Data).
- Administrator:
- ensures transparency of the processing of Personal Data;
- informs about the processing of data at the time of their collection, in particular about the purpose and legal basis for the processing of Personal Data, unless under separate provisions he is not obliged to do so;
- ensures that data on the use of the Website, in particular such as: IP number, data on the User’s movements on the Website, as well as data as part of the recruitment process referred to in Chapter 10 of the Privacy Policy, are collected only in the scope of necessary for the indicated purpose.
3. PURPOSE AND LEGAL BASIS OF DATA PROCESSING
- Any Personal Data provided by the User will be processed only for the purpose for which they were provided, unless the User gives separate consent to the processing of his Personal Data for other purposes.
- Data regarding name and surname, telephone number, e-mail address (if provided during contact) will be processed only for the purpose of establishing contact, answering questions, as part of activities undertaken before the conclusion of the contract (Article 6(1)(b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – hereinafter: GDPR)
- Data on the use of the Website, including such as the IP address or data on movements on the Website are processed in order to optimize the operation of the Website, facilitate the use of the Website by Users, eliminate errors in the operation of the Website, etc., they can also be used in the case of proceedings related to illegal using the Website as a legitimate interest of the data controller (Article 6(1)(f) of the GDPR).

- The User also has the right to withdraw any given consent, however, the withdrawal of consent does not affect the lawfulness of the processing which was made on the basis of consent before its withdrawal.
- To the extent provided for by law, the User also has the right to lodge a complaint with the competent supervisory authority, i.e. the President of the Office for Personal Data Protection.
- Any changes inthe User may make a relevant declaration of will to the Administrator’s address at kontakt@tbm.info.pl. At the same address or another address indicated on the Website, the User may contact him regarding the exercise of his rights related to the processing of his personal data.
7. THIRD PARTY ACCESS
- Only authorized employees or associates of the Administrator and authorized persons dealing with the operation of the Website, who have been granted appropriate authorizations, have direct access to Personal Data collected by the Administrator.
- Users’ Personal Data may be made available to entities authorized to receive them under applicable law, in particular to the competent judicial authorities.
- The recipients of the data may be entities operating the Administrator’s Website, personnel consulting entities, as well as other entities to which the Administrator may commission activities in connection with the processing of candidates’ personal data. In the case of contact via Facebook, the recipient of the data is also Facebook Ireland Ltd.
- Personal data may also be transferred to third countries, i.e. outside the European Economic Area. In this case, the transfer of data is based on appropriate safeguards in accordance with the provisions on the protection of personal data.
- If you contact us via our social media, i.e. via Facebook, this entity becomes a separate administrator of your personal data and your data will be processed based on the regulations of this portal. In this case, they may also be processed outside the European Economic Area. Regardless of this, the Administrator remains the administrator of your personal data. Data such as name and surname, nickname, image, public profile and others. we process in order to respond to messages and comments received from you, to improve communication and maintain relationships, i.e. as the implementation of the Administrator’s legitimate interest (Article 6(1)(f) of the GDPR).
8. PERSONAL DATA PROCESSING PERIOD
- The period of processing Personal Data by the Administrator depends on the type of service provided and the purpose of processing and is no longer than for a period of 5 years, unless you request the deletion of your data earlier. Your personal data may also be processed for the period of limitation of claims related to the processing of personal data for the purposes set out above.
- In the case of processing Personal Data on the basis of the Administrator’s legitimate interest – e.g. for security reasons, Personal Data are processed for the period enabling the implementation of this interest, in particular for the period of limitation of claims or until the final conclusion of court proceedings.
- After the expiry of the processing period, Personal Data is irreversibly deleted or anonymized.

9. INTELLECTUAL PROPERTY RIGHTS

- This Privacy Policy informs about the methods of protecting Personal Data provided by job candidates (hereinafter: Job Candidates) in the attached recruitment documents, processed by the Administrator.

- Personal data of Job Candidates are processed in order to:
- recruitment for a position in line with your candidate profile based on:
- article 6 sec. 1 lit. c GDPR – in relation to the data indicated in art. 221 §1 of the Labor Code, subject to Art. 221 § 2 of the Code of Civil Procedure, where processing is necessary to fulfill the legal obligations incumbent on the Administrator;
- article 6 sec. 1 lit. and the GDPR in connection with joke. 221a §1 KP – in relation to data that goes beyond the catalog indicated in art. 221 §1 of the Code of Civil Procedure, where the processing is based on consent;
- recruitment for a position in line with your candidate profile based on:
if the recruitment concerns employment under an employment contract,
- recruitment for a position in accordance with your candidate profile pursuant to art. 6 sec. 1 lit. b GDPR in relation to all personal data provided by you, where the processing is carried out at the request of the Job Candidate;
- pursuing or defending against claims related to the recruitment process, due to the legally justified interest of the Administrator, pursuant to art. 6 sec. 1 lit. f GDPR – when processing is necessary for purposes arising from legitimate interests pursued by the Administrator,
if the recruitment concerns employment under a cooperation agreement;
- The consent to data processing may be withdrawn at any time in any form; withdrawal of consent does not affect the lawfulness of the processing which was made on the basis of consent before its withdrawal.
- Personal data of Job Candidates may be transferred only to: authorized employees of the Administrator, external entities providing services to the Administrator, in particular in the field of e-mail hosting, IT services, entities and bodies to which the Administrator is obliged to provide data on the basis of generally applicable law.
- Personal data may also be transferred to third countries, i.e. outside the European Economic Area. In this case, the transfer of data is based on appropriate safeguards in accordance with the provisions on the protection of personal data.
- Personal data of Job Candidates will be processed:
- in relation to the data indicated in art. 221 §1 of the Labor Code, in the absence of consent to the processing of personal data – until the end of the recruitment process,
- in relation to the data indicated in art. 221 §1 of the Civil Code, in the case of consent to the processing of personal data – for a period of 3 years from the consent,
- in relation to data that goes beyond the catalog indicated in art. 221 §1 of the Civil Code, in the case of consent to the processing of personal data – for a period of 3 years from the consent,
- in order to pursue or defend against claims related to the recruitment process – until the expiry of the limitation period for the indicated claims.
After the processing is completed, the Personal Data of Job Candidates will be deleted.
- The Job Candidate has the right to demand from the Administrator access to his data, rectification, deletion or limitation of processing and the right to object to the processing, and in the scope of data made available on the basis of voluntary consent, also the right to withdraw consent at any time without affecting compliance with the law. the right to processing, which was made on the basis of consent before its withdrawal.
- A job candidate has the right to lodge a complaint with the President of the Personal Data Protection Office if you decide that the processing violates the law.
- Providing data by the Candidate to the extent required by law is a statutory requirement, and failure to provide such data results in the inability to apply for employment; providing data other than those required by law is voluntary.
- The Administrator will not make decisions regarding the Job Candidate based solely on automated processing, including in the form of profiling.
- The Personal Data of the Job Candidate will be processed until the end of the recruitment process or, in the event of consent, also in future recruitment procedures, no longer than for a period of 36 months, unless you request the deletion of your data earlier. Personal data of the Job Candidate may also be processed for the period of limitation of claims related to the processing of personal data for the purposes set out above.
11. COOKIES
Cookies (pol. “Cookies”) mean IT data, in particular small text files, saved and stored on the Website User’s end devices, through which Users use the Website. Cookies usually contain the address of the website they come from, their storage time on the end device and a unique number. The Administrator places Cookies on the Website User’s end device and gains access to data from these files.

- Administrator’s Cookies – means Cookies placed by the Administrator, related to the provision of electronic services by the Administrator via the Administrator’s websites.
